The appeals court will deal with the case for the second time.
In February, a high court acquitted her of murder charges, but the Supreme Court has cancelled the verdict and ordered new proceedings.
Supreme State Attorney Renata Vesecka disagreed with the high court's verdict that stopped Brozova-Polednova's prosecution, saying the case was statute-barred.
A court accepted Vesecka's view that Brozova-Polednova had played an active role in the five-member panel of prosecutors. Brozova-Polednova then complained against its decision.
The proceedings against the former prosecutor that started last summer are to continue in September.
Brozova-Polednova is the first participant in the trial of Horakova to face a trial herself.
Horakova, a lawyer by profession, gave up her mandate of Czechoslovak parliament deputy in protest against the Communist takeover in 1948. Later she unsuccessfully initiated concerted efforts of the non-Communist parties.
