counterpart Condoleezza Rice in July.
The criminal complaint was lodged by student Martin Kadrman, but the Prague State Attorney's Office did not start any proceedings in the case.
The procedure was later upheld by the High State Attorney's Office, Zenklova said.
Tyden.cz server writes Kadrman is not be satisfied with the ruling and that he wants to turn to Supreme State Attorney Renata Vesecka.
The treaty Schwarzenberg and Rice signed after two years of negotiations enables the United States to build a radar base on Czech soil within its anti-missile shield.
The treaty is yet to be ratified by parliament and signed by the president.
Support for the treaty in parliament is not, however, sure.
Public opinion polls show that a majority of Czechs are opposed to the project.
The United States also wants to build a base for ten interceptor missiles in Poland.
The aim of the bases is to protect the United States and a major part of Europe against missiles that states like Iran might launch.
